RODER SRL, with registered office at Via Aldo Moro 15/A, 10080 Oglianico (TO), Italy, VAT number IT09772700010, is the owner of the website http://www.roder.it .
1) ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
1.1 The contract entered into between RODER SRL and the Customer shall be deemed concluded upon acceptance of the order by RODER SRL. By placing an order online, by telephone, by fax or by e-mail, the Customer declares that they have read and fully accept the general conditions of sale and payment set out below.
1.2 The Customer must print or save an electronic copy of these general conditions of sale and retain them in any case.
2) HOW TO PURCHASE
2.1 The Customer may purchase the products sold in the electronic catalog on the website http://www.roder.it as described in the relevant technical information sheets or in communications by e-mail. All purchasing guidance provided on the site is to be regarded as general information material only, and does not necessarily reflect the actual characteristics of any individual product.
2.2 Receipt of the order is confirmed by RODER SRL by e-mail sent to the address provided by the Customer. This confirmation message states the order or reference number, the order date, the billing details and the consignee of the goods, the details and prices of the goods ordered including VAT, the shipping service and any additional services, the payment method, RODER SRL’s details, and notes and warnings for the customer.
2.3 Once the order has been received from the Customer, RODER SRL staff will verify payment and product availability and will process and accept the order.
2.4 Any notice that the order has not been accepted because the product is unavailable and/or because delivery times are longer than those stated in the product sheet will be communicated to the customer promptly, by telephone or by e-mail. In such cases the Customer may change the product, wait for availability within the new times communicated, or cancel the order and request a refund of any sum already paid.
2.5 Any right of the Customer to compensation for damages is excluded, as is any contractual or non-contractual liability for direct or indirect damage to persons and/or property caused by the non-acceptance, including partial non-acceptance, of an order.
2.6 Cancellations of or changes to an order already submitted may be made by the customer within 24 hours of placing it and must be sent to RODER SRL in writing by e-mail. Beyond that period (24 hours), cancellations or changes cannot be guaranteed and will be authorized by RODER SRL, where applicable, on the basis of the progress of the order.
2.7 The images accompanying a product’s technical sheet may not be perfectly representative of its characteristics.
3) DELIVERY TIMES
3.1 RODER SRL undertakes to carry out delivery in the shortest possible time.
3.2 Every quotation and/or order confirmation states the average times for the production and delivery of the product; these must not be regarded by the Customer as binding with respect to the conclusion of the contract entered into with RODER SRL.
3.3 Any advance or delay in the delivery times indicated or provided by e-mail or telephone that cannot be identified at the time of the order but only during its preparation or production will be communicated promptly as soon as RODER SRL becomes aware of it. In any case, such changes may not be relied upon by the customer to claim compensation or indemnity, nor to assert any contractual or non-contractual liability for direct or indirect damage to persons and/or property.
4) SHIPMENT AND DELIVERY
4.1 Purchases made on http://www.roder.it are delivered by national and international express couriers to the delivery address given when the order is placed. During the ordering procedure it is possible to indicate a contact person and a place of delivery different from the details provided for the order heading and invoicing.
4.2 For every order placed, RODER SRL issues an appropriate document accompanying the goods shipped (accompanying invoice or transport document). These documents are issued on the basis of the information provided by the Customer when the order is placed. Once the invoice has been issued, it cannot be amended.
4.3 Shipping costs are calculated on the basis of the volume of the goods and the place of destination.
4.4 The Customer may communicate any detail they consider necessary for the courier to reach the place of delivery, by noting it in the order notes or by sending an e-mail to info@roder.it before the goods are shipped.
4.5 RODER SRL informs the customer by e-mail of the imminent shipment.
4.6 Standard delivery is made at street level.
4.7 Deliveries made to difficult locations such as smaller islands, mountain areas that are hard to reach, and pedestrian and/or restricted-access zones not suited to normal goods vehicles, where the customer has not informed RODER SRL in advance, may be subject to a price supplement, which will be communicated to the customer by e-mail as soon as possible and in any case before the goods are shipped.
4.8 National and international couriers make deliveries from Monday to Friday, during the normal working hours set and stated by the couriers themselves, over which RODER SRL has no control.
4.9 No liability may be attributed to RODER SRL for delays in delivery attributable to the appointed carrier.
4.10 In the event of tampering with and/or damage to the packaging, the customer must accept the goods “SUBJECT TO INSPECTION”, personally describing the damage in detail on all copies of the courier’s delivery receipts. Example: “Goods accepted subject to inspection owing to damaged packaging”. In the event of evident damage to the products, the customer may refuse delivery outright, personally stating on all copies of the courier’s delivery receipts the reason for not accepting them. Example: “I am not accepting the goods owing to evident damage to the packaging and to the products inside”.
4.11 At the time of delivery the courier is required to wait only while the Customer checks that the packaging is intact. Opening the packaging and checking that the products inside are intact must be carried out by the Customer afterwards. The original packaging and any accessories must in any case be kept for the entire duration of the product warranty, so that they can be reused in the event of returns, defects or other issues.
4.12 Once damage caused by transport has been established, the customer must report it to RODER SRL within 5 (five) days of receiving the goods by e-mail, together with photographic documentation of the packaging and of the damaged goods.
4.13 A Customer who for any reason has not followed the instructions set out above in this contract may not subsequently claim from RODER SRL for any shortages or damage caused by the carrier.
5) WARRANTY, RETURNS AND REPLACEMENT OF PRODUCTS
5.1 All products are covered by warranty for the period stated in our quotations and/or order confirmations, starting from the date of our invoice. The warranty excludes in any case any recourse for damages. RODER SRL is in any case entitled to decide whether to repair or replace a product. The company does not accept returns or replacements. Every return must be authorized in advance by RODER SRL. Otherwise it will be rejected. If the return is accepted by us because it has been authorized, a charge will be applied (varying between 10% and 20% of the net price of the product, depending on the product, type and so on) for handling it, repackaging, checking that it is intact and so on. Under no circumstances will products be accepted that are not in the price list, that lack the original packaging, or that are worn, incomplete or show signs of use. Transport costs for returns are borne by the Customer. These general conditions are also valid and applicable to any product replacement due to an incorrect order, provided that this has been agreed and accepted by RODER SRL.
6) RIGHT OF WITHDRAWAL
6.1 In compliance with Italian Legislative Decree 206/2005 (Consumer Code), the CONSUMER has the right to withdraw from the contract, without giving reasons, within 14 days. Consumer or Customer means a natural person who purchases for purposes unrelated to any professional, business or craft activity they may carry out. THE RIGHT OF WITHDRAWAL DOES NOT APPLY in the case of purchases made for business or professional activity (sales invoiced to a VAT number). The withdrawal period ends 14 days after the consumer takes physical possession of the goods. To exercise the right of withdrawal the consumer must inform RODER SRL of their decision by e-mail to info@roder.it or by fax to 0124-470611. The costs of returning the goods (as well as the risks arising from transport) are borne entirely by the Customer. The goods must be sent to the following address: RODER SRL – Via Aldo Moro 15/A – 10080 Oglianico (TO).
6.2 Effects of withdrawal: if you withdraw from the contract of sale, all payments you have made to us will be refunded, including delivery costs where applicable, without delay. These refunds will be made using the same payment method you used for the initial transaction, unless otherwise agreed. In any case you will bear no cost as a consequence of such a refund. Where the Customer validly and promptly exercises the right of withdrawal, RODER SRL will refund the payment received without undue delay and in any case within 14 days from the moment it was informed that the Consumer Customer was exercising the right of withdrawal. The refund may be withheld until the goods are received or until the consumer has provided evidence of having sent the goods back, whichever is the earlier.
6.3 Diminished value and grounds for exclusion: goods covered by a valid right of withdrawal exercised by the Consumer must be returned to RODER SRL in the same condition in which the Consumer received them, complete with all their parts, with the original packaging and any manuals supplied, and without the Consumer having used, consumed or damaged them. RODER SRL reserves the right not to accept the return of products by the consumer where their essential characteristics or quality have been altered, or where they have been damaged. In such cases RODER SRL will return the goods to the consumer carriage forward, with shipping costs payable by the recipient.

8) UPDATES
8.1 In order to provide a service that is always up to date, RODER SRL reserves the right to modify at any time and without notice the technical data, texts, drawings, descriptions, graphics, photographs, variants and colors, item availability, delivery times, general conditions of sale and any other part contained in the website http://www.roder.it and in all other partner sites.
9) PLACE OF JURISDICTION
For any dispute or claim arising in any way from this contract, the Court of Turin shall have exclusive jurisdiction.
